Describe the elements of Whistleblowing

The elements of whistle-blowing envisage the why, what, and where. Before the employees are encouraged to speak up against injustice or ethical violations, there have to be laws or established ethical frameworks to justify reasons why they must speak up. Besides, whistleblowing is only effective if employees comprehend what they need to speak up against. Per Watts and Buckley, whistleblowing depends on the type of industry a person works in (673). If a person is working in a manufacturing plant, he or she can speak up against operating industrial machines without appropriate safety attire. Consequently, whistleblowing is wholly successful if whistleblowers are aware of where and how they can report their complaints.

What happened to the NH Whistle-Blower?

The whistleblower in the New Hampshire case was dismissed from employment. The case involved Cluff-Landry and the Roman Catholic Bishop of Manchester in which the former was a pre-kindergarten arts teacher (DeLuca n.p). The complainant reported that a particular student endangered the lives of other students and staff. The principal laughed and resorted to retaliatory acts by dismissing the worker. Three years later, the worker filed a lawsuit claiming a violation of the whistleblower act. The Supreme Court upheld her dismissal referring to ineffective internal policies within the institution.

Compare the New Hampshire case to the tenets of the definition of a Whistle Blower

A whistleblower is required to make a reasonable effort to resolve the situation using internal company structures or policies. In the event that an employee is unable to resolve a problem through the internal mechanisms, the said employee can lodge complaints in the New Hampshire Department of Labor. The New Hampshire case exposes the technicalities of handling a violation involving internal organizational structures and policies. There are no defined standards sets for internal structures thereby subjecting employees to retaliation by their employers. In the case, the complainant stated that she tried on numerous occasions to resolve the issue internally but failed (Parent n.p). Therefore, enforcing the whistleblower’s act is complex in the absence of strong internal organizational mechanisms. Additionally, the whistleblower Act is suited for actins that directly violate local, state, or federal laws.
